While PrisonArte endeavors to present the most accurate information on its site, there may be times when the site contains incomplete or inaccurate data, including typographical errors or inaccuracies.

 

Any errors are wholly unintentional, and PrisonArte shall have the right to:

(1) Refuse or cancel any orders placed for product listed at the incorrect price;

 

(2) Refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged (please note, to the extent your credit card has already been charged for the purchase and your order is cancelled, 

 

PrisonArte shall issue a credit to your credit card account in the amount of the incorrect price).

We strive to maintain safe communication as Intermediaries with incarcerated individuals. We strongly advise that you not communicate, share or receive direct communication with inmates. PrisonArte is not liable for any promises or claims made direct by any inmates. PrisonArte works on making doing their best to choose artists that are working towards positive reintegration into society.

 

Privacy Policy

 

PrisonArte (we” or “us”) values its visitors’ privacy. This privacy policy is effective November 2, 2013; it summarizes what information we might collect from a registered user or other visitor (“you”), and what we will and will not do with it.

 

Please note that this privacy policy does not govern the collection and use of information by companies that PrisonArte does not control, nor by individuals not employed or managed by PrisonArte If you visit a Web site that we mention or link to, be sure to review its privacy policy before providing the site with information.

 

What we do with your personally identifiable information

 

It is always up to you whether to disclose personally identifiable information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with any products or services. “Personally identifiable information” means information that can be used to identify you as an individual, such as, for example:

 

  • your name, company, email address, phone number, billing address, and shipping address

  • your PrisonArte Artist ID and password

  • credit card information

 

The above provision may not be appropriate if credit card information is handled by a payment processor.

 

  • any account-preference information you provide us

  • your computer’s domain name and IP address, indicating where your computer is located on the Internet

  • session data for your login session, so that our computer can ‘talk’ to yours while you are logged in

 

If you do provide personally identifiable information to us, either directly or through a reseller or other business partner, we will:

 

  • not sell or rent it to a third party without your permission — although unless you opt out (see below), we may use your contact information to provide you with information we believe you need to know or may find useful, such as (for example) news about our services and products and modifications to the Terms of Service;

  • take commercially reasonable precautions to protect the information from loss, misuse and unauthorized access, disclosure, alteration and destruction;

  • not use or disclose the information except:

  • as necessary to provide services or products you have ordered, such as (for example) by providing it to a carrier to deliver products you have ordered;

We may collect other information that cannot be readily used to identify you, such as (for example) the domain name and IP address of your computer. We may use this information, individually or in the aggregate, for technical administration of our Web site(s); research and development; customer- and account administration; and to help us focus our marketing efforts more precisely.

PrisonArte uses “cookies” to store personal data on your computer. We may also link information stored on your computer in cookies with personal data about specific individuals stored on our servers. We may store your data on servers provided by third party hosting vendors with whom we have contracted.

  • to log off the PrisonArte Web site when you are finished;

PrisonArte ‘s operations are located primarily in the United States. If you provide information to us, the information will be transferred out of the European Union (EU) to the United States. By providing personal information to us, you are consenting to its storage and use as described herein.

 

Information collected from children

You must be at least 18 years old to use PrisonArte ‘s Web site(s) and service(s). PrisonArte does not knowingly collect information from children under 13. (See the U.S. Children’s Online Privacy Protection Act.)

Such Submissions shall constitute an assignment to PrisonArte of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Submissions.

PrisonArte shall be free to use the content of any such communications, including any ideas, inventions, concepts, techniques or knowledge disclosed therein, for any purpose, including the development, manufacturing and/or marketing of goods or services.

 

Any original pictures submitted to PrisonArte shall be destroyed upon completion of project by inmate. Please do not submit originals that have not been copied for your own files. Pictures will not be returned unless requested by buyer and seller agrees to with appropriate postage for return is provided by buyer to seller. 

 

PrisonArte is under no obligation to (i) respond to any Submissions, (ii) maintain Submissions in confidence, or (iii) pay compensation of any kind for your Submissions. Any Submissions by you is a declaration on your party of the full release of all proprietary claims and/or intellectual rights regarding your Submissions.

 

We will not use your name in connection with any such Submissions unless we first obtain your permission or otherwise are required by law to do so.

 

Copyright vs. Derivative work:

PrisonArte offers varied types of artwork created by incarcerated individuals. Artwork is either a replica of a specific item or theme. Our goal is to offer artwork that is protected under the Derivative Works and Compilations regulations. A derivative work is based on one or more already existing works. Art reproductions, abridgments and condensations of preexisting works. Examples of said work can be

  • a sculpture based on a drawing

  • a lithograph from a painting

  • a painting from a photograph

At PrisoneArte we do not claim to hold any copyrights unless noted. Artwork that is created and designed as an original will be noted specifically on that item.

PrisonArte offers varied types of artwork created by incarcerated individuals. Artwork  that is copied or a replica of an image submitted by customer is the sole property of customer. The following applies 

  • Original image must be emailed to Prisonarte

  • Digital copy will be deleted from our files once it the project is completed

  • Incarcerated artist receives a copy and returns said copy along with the finished project

  • Custom artwork is non-refundable

  • We make no claims on perfect copy in drawing or painting, but expect a high quality product

  • Finished project is inspected prior to shipping to customer

  • No claims on absolute size due to some artist could not have access to proper measuring tools

  • Prisonarte.com reserves the right to use finished project on webs ite and social media sites

  • If customer does not want their finished project shared on website or social media sites, please advise us immediatley

Artist Participation Policies

Incarcerated artists needs to mail us a self addressed prepaid envelope for an application

Some prisons frown on inmates selling their artwork outside the facility. Please check with your facility, hobby shop or case manager to make sure your correctional facility allows you to sell and earn money.

Prisonarte.com keeps 20% of the selling price. Tax and shipping fees are not included in calculating our fee, taxes and shipping fees. The 20% allows us to pay for added marketing, taxes, cost to maintain site, supplies like added shipping requirements, packaging, storage and to pay the fees to PayPal for CC

Ø  Once artist sells a piece, we send the 80% of the selling price (not including tax, processing and shipping)

Ø  Artwork is shipped to Prisonarte.com at the designated/artists expense and their own risk. See Instructions PA003 DO NOT SEND ARTWORK UNTIL YOU ARE APPROVED

Ø  Some states do not allow inmates to make money off their artwork due to money owed to the state.  We value confidentiality 

Ø  We note the artwork as sold on the website once it sells, so family members can see if it's sold

Ø  Once approved it is the artist and designated person’s responsibility to keep the artist active by sending us artwork.  We prefer that it is sent in by the artist.

Ø  Family member can ask us to post the artwork for 6 months and then if it does not sell, return to designated member.  If they choose this option, we just ask that they include return postage. 

Ø  During those 6 months, there is no cost to them.  We pay for marketing costs. 

Ø  If artist sells out on his collection, he is dropped from site after 30 days due to inactivity (nothing to sell) in order to make room for other artists.  Once dropped they would need reapply and we cannot guarantee available spots.

Ø  We do not make guarantees that the artwork will sell

Ø  We do not use our site for pen pal activity/communication

Ø  Artwork MUST be shipped to SG Sales at your expense in order to be added to the website (item must be inspected in order to verify quality, size, material).

Ø  SG Sales manages shipping to customers and is held responsible for accurate shipping.

Ø  Artists that have not been approved that send in artwork will be automatically rejected.

Ø  If artwork is received without pre-approval, Prisonarte.com maintains the right to hold artwork for 45 days until artist sends instructions for return shipping (Postage prepaid)

Ø  Failure to arrange return shipping, after 45 days, Prisonarte reserves the right to sell artwork as a clearance item with artist name undisclosed in order to move out inventory.

Ø  Unauthorized artwork held after 45 days will be considered donated to Prisonarte.com by the artist.

Artwork marked Consignment: 

We have a partner ship with art galleries and other art venues that request us to send them art on consignment. Prisonarte gives authority to these consignment location to sell these pieces.

Money for these sales are sent to Prisonarte in order for us to pay the artist. If you are interested in one of those pieces marked consignment please email us directly or message us through chat icon

Prices for these items are the same as noted on our site and any discounts offered on Prisonarte.com still apply. 

There is a $4.99 processing fee that applies on these items to help over the cost of consignment venue processing to fill order. 

Order will still be purchased through PayPal. 

Prisonarte will make item available on the site for customers to purchase once customer has agreed and confirmed they are going to purchase. 

Availability for these items on the site will only held open for a period of 24 hours. If customer does not purchase during that time, the item will be marked back on consignment
